1. Agreement

These Terms of Service ("Terms") are an agreement between you and Mohamad Baydoun, trading as Brilliants9 ("Brilliants9", "we", "us"), based in Lebanon. They apply to Brilliants9 Business AI at ai.brilliants9.com, the website assistant, the messaging integrations, and our website brilliants9.com (together, the "service"). By creating an account or using the service, you agree to these Terms and to our Privacy Policy, which forms part of them.

If you use the service for an organization, you confirm that you are authorized to accept these Terms for it, and "you" means that organization.

2. Who may use the service

  • The service is for business use. Account holders must be at least 18 years old.
  • You must give accurate registration information and keep it up to date.
  • You are responsible for keeping your sign-in details secure, for everything done through your account, and for the staff members you invite. Tell us at once at support@brilliants9.com if you suspect unauthorized use.

3. The service

Brilliants9 Business AI lets a business upload its own content, such as documents, questions and answers, and product catalogs, and create an AI assistant that answers its customers from that content. The business can place the assistant on its website, connect it to WhatsApp, Facebook Messenger, and Instagram, see conversations in an inbox, hand conversations to its staff, and view usage and analytics. Features differ by plan and may change as we improve the service.

4. Your responsibilities

  • You must have the rights to the content you upload and to the messaging accounts you connect.
  • You are responsible for your assistant's content and settings, and for keeping your information accurate and current.
  • You must tell your customers, in your own privacy notice, that you use an AI assistant and service providers such as Brilliants9, and obtain any consent the law requires, including before sending them marketing messages.
  • You should review how your assistant answers and step in with a person where a conversation needs one.

5. AI limitations

The assistant generates replies with artificial intelligence. It is designed to answer only from your content, but AI output can be wrong, incomplete, or out of date, and the service may be interrupted. The assistant does not give professional medical, legal, financial, or other expert advice, and you should not rely on it for decisions that need such advice. You remain responsible for what your assistant tells your customers.

6. Messaging channels

When you connect WhatsApp, Messenger, or Instagram, you must also follow the terms and policies of Meta Platforms for those products, including the WhatsApp Business Messaging Policy, customer opt-in requirements, message template rules, and time limits for replying to customers. You must also follow anti-spam and consumer-protection laws. Meta may limit or suspend your use of its products; we are not responsible for Meta's decisions.

7. Acceptable use

You must not use the service to:

  • break any law or anyone's rights, including privacy and intellectual property rights;
  • send spam or unsolicited messages, or message people who have not agreed to hear from you;
  • deceive people, including by pretending to be someone else or hiding that they are talking to an automated assistant where the law requires disclosure;
  • harass, threaten, exploit, or harm anyone, including children;
  • upload malware, or try to access accounts, data, or systems without permission;
  • copy, scrape, or reverse engineer the service, get around its limits or security, or overload it; or
  • make fully automated decisions with legal or similarly significant effects on people, or use the service where its failure could cause death, injury, or serious damage.

8. Your content

You keep ownership of the content you upload and the conversations of your customers. You give us a limited permission to store, copy, process, and transmit that content only as needed to provide, secure, support, and improve the service, as described in our Privacy Policy. This permission ends when the content is deleted from the service, except for copies kept for a limited time in backups.

9. Our service and feedback

We own the service, including its software, design, and brand. We give you a limited, non-exclusive, non-transferable right to use it during your subscription under these Terms. If you send us suggestions, we may use them without any obligation to you.

10. Third-party platforms

The service depends on third parties such as Meta, OpenAI, Google, and our hosting provider. Their outages, policy changes, account restrictions, or withdrawn permissions can affect the service, and we are not responsible for them. Your use of their products is governed by their own terms.

11. Plans, limits, and invoices

Each plan has usage limits, such as the number of messages or documents. We may pause features when a limit is reached. We do not currently take card payments in the service; paid plans are agreed with us directly and invoiced manually, on the terms stated in the invoice or order. We will tell you in advance before we change the price of a plan you have already paid for.

12. Privacy and confidentiality

We handle personal information as described in our Privacy Policy. When we process your customers' messages, we do so on your behalf and follow your settings. We keep your content confidential and share it only with the service providers needed to run the service, or where the law requires.

13. Suspension and termination

  • You may stop using the service at any time, disconnect your channels, export your data from your settings, and delete your account.
  • We may suspend or close an account that breaks these Terms, puts the service or other users at risk, or where the law requires, and we will tell you why unless we are not allowed to.
  • When an account is closed, we delete its data as described in our Data Deletion Instructions.

14. Disclaimers

To the extent the law allows, the service is provided "as is" and "as available", without warranties of any kind, including that it will be uninterrupted, error-free, or that every AI reply will be correct.

15. Limitation of liability

To the extent the law allows, we are not liable for indirect or consequential losses, or for lost profits, revenue, data, or goodwill. Our total liability for any claim related to the service is limited to the amount you paid us for the service in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law.

16. Indemnity

You will cover our reasonable losses and costs from claims by others arising from your content, your messages to your customers, or your breach of these Terms or of the law.

17. Governing law

These Terms are governed by the laws of Lebanon. Before going to court, please contact us so we can try to resolve the issue. Any dispute that cannot be resolved this way will be decided by the courts of Beirut, Lebanon.

18. Changes to these terms

We may update these Terms as the service changes. We will change the "Last updated" date above and, for significant changes, notify business customers by email or in the dashboard before the change takes effect. If you keep using the service after that, you accept the updated Terms.
